29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not conducted at least once every three years: Terminal: On, or about, November 14, 2018, an employee who operated a forktruck had not been provided with refresher training/evaluation since May 29, 2015. New Penn Motor Express LLC was previously cited for a violation of this Occupational Safety and Health Standard, which was contained in OSHA Inspection Number 962707, Citation Number 1, Item Number 3b and was affirmed as a Final Order on June 25, 2014, with respect to a workplace located at North Billerica, Massachusetts.

29 CFR 1910.303(g)(1)(ii): The required working space about electric equipment rated 600 volts, nominal, or less to ground, was used for storage: Electrical Room: On, or about, November 14, 2018, boxes, floor mats, a board and a safety cone were stored in front of the ITE switchboard that contained the main disconnect and Panel PN, an ITE panelboard that contained circuit breakers for general wiring in the building.
