A specific instance of this continuing violation was most recently observed on or about August 16, 2018, when employees were performing residential roofing activities while using pneumatic nail guns without wearing impact resistant safety eyewear. The employer's ongoing obligation is to ensure that the proper safety eyewear is worn during pneumatic nail gun usage.

The employer's ongoing obligation is to ensure that fall protection equipment and/or methods are in use when employees are exposed to fall hazards.

A specific instance of this continuing violation was most recently observed on or about August 16, 2018, when employees were performing residential roofing activities were using an extension ladder that was not extended at least three feet above the upper landing surface. Alternatively, the ladder was not secure, nor had grasping devices available for the employees use. The employer's ongoing obligation is to ensure that portable ladders are set for the proper working length.
