29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of fifty percent: a) On or about August 16, 2018 and September 7, 2018 on the penitentiary grounds, employees were exposed to occupational levels of noise measured at 86.8, 89.8, and 88.9 dBA as an 8-hour time-weighted average while operating riding lawn care equipment and the employer did not administer to these employees a continuing, effective hearing conservation program as described in paragraphs (c) through (o).

29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided in this paragraph by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels: a) On or about August 16, 2018 and September 7, 2018 on the penitentiary grounds, employees were exposed to occupational levels of noise measured at 86.8, 89.8, and 88.9 dBA as an 8-hour time-weighted average while operating riding lawn care equipment and the employer did not establish and maintain an audiometric testing program to include all employees exposed to occupational noise levels equal or exceeding a time-weighted average of 85 dBA.
