29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): a) Adjacent to Route 73 - Employee without proper protection from potential cave-in, worked in the bottom of an excavation approximately 6 feet 2 inches deep with a nearly vertical side wall on the south side, east side, and improperly benched side wall on the north side, measuring approximately 11 feet by 21 feet, on or about 08/23/2018. Mancuso Contractors & Excavators, Inc. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD, ITS EQUIVALENT, OR ESSENTIALLY SIMILAR STANDARD 29 CFR 1926.652(a)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 981700 CITATION NUMBER 1, ITEM NUMBER 02 AND WAS AFFIRMED AS A FINAL ORDER ON 11/12/2015, WITH RESPECT TO A WORKPLACE LOCATED AT 500 Route 38, Cherry Hill NJ, NEW JERSEY, 08002. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
