29 CFR 1926.1153(c)(1):  For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, and in the alternative, did not properly assesses the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.     a) Holtec Drive, Evesham, NJ :  On or about Jan 2, 20919 Mancon Enterprises LLC employees were cutting asphalt using a hand held Stihl job saw.  The saw was not equipped with engineering controls conforming to Table 1 Section (xi) of this standard.  The cutting creating a visible cloud of dust that potentially contained respirable silica.  Additionally, the employer had not conducted a proper assessment of potential employee exposure to respirable crystalline silica.     NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
