OSH ACT of 1970 Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, an outside contractor and an outside subcontractor performed work activities where high temperature liquids were released: (a) Danone North America at the address of 216 Southgate Drive in Minster, Ohio; or about August 22, 2018, certain construction work activity was performed by an employee of IMS at the direction of The Dennis Group. The Dennis Group was retained by Danone North America to install new equipment at the Southgate Drive facility. IMS was a subcontractor to The Dennis Group in connection with the installation of the new equipment. Without the knowledge of Danone North America, an IMS employee replaced a cluster valve body of valve 282AV1342, exposing that employee to hazards associated with high-temperature liquids from valve 282AV1340. Although Danone North America had previously developed a permit for the subject work, The Dennis Group modified the subject work without informing Danone North America; also, The Dennis Group directed the IMS employee to perform the subject work in a certain manner, without Danone North America's knowledge. Danone North America did not obligate its contractors to notify the company in the event of a change of work specified in a permit issued by Danone North America.
