29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before use of the respirator in the workplace:          a.)  CMG Process, Inc. dba Apex Engineered Products, Shop areas, on or about August 29th,2018 and times prior thereto:  Employees were voluntarily wearing elastomeric half mask, air purifying respirators (Honeywell North brand #7190 with N99 filters) during welding operations at the facility.  Employees were not provided with a medical evaluation prior to the use of the respirators onsite.

29 CFR 1910.134(c)(1): The respiratory protection program was not updated as necessary to reflect those changes in workplace conditions that affected respirator use:    a.)  CMG Process, Inc. dba Apex Engineered Products, shop areas, on or about August 29th,2018 and times prior thereto:  Employees were voluntarily wearing half mask elastomeric, air purifying respirators (Honeywell North brand #7190 with N99 filters) during welding operations at the facility.      The company's written respiratory protection program did not include updated site specific information including, but not limited to, the following:    1) The program did not describe the types of respirators that were available to employees.       2) Identification of the physician or other licensed health care professional that will conduct medical evaluations.     3) Information regarding the requirement to provide medical evaluations for employees who don half mask elastomeric respirators voluntarily.

29 CFR 1910.106(e)(2)(iv)(d): Flammable liquids were not drawn from or transferred into vessels, containers, or portable tanks within a building only through a closed piping system, from safety cans, by means of a device drawing through the top, or from a container or portable tanks by gravity through an approved self-closing valve:           a)  CMG Process, Inc. dba Apex Engineered Products, West wall of "lower shop area", On or about August 29th, 2018 and times prior thereto:  Employees were dispensing a category 2 flammable liquid (acetone) into secondary containers in order to clean metal parts.  The dispensing valve for the flammable liquid was not self-closing.

29 CFR 1910.106(e)(6)(i): Adequate precautions were not taken to prevent the ignition of flammable vapors:    a)  CMG Process, Inc. dba Apex Engineered Products, West wall of "lower shop area", On or about August 29th, 2018 and times prior thereto:  Employees were dispensing a category 2 flammable liquid (acetone) from a 55 gallon drum into secondary containers in order to clean metal parts.  The 55 gallon drum of acetone was not grounded to provide the dissipation of static electricity associated with dispensing the liquid from the drum to smaller containers.

29 CFR 1910.106(e)(6)(ii): A Category 2 flammable liquids with a flashpoint below 100 °F (37.8 °C) was dispensed into containers without the nozzle and container electrically interconnected:    a)  CMG Process, Inc. dba Apex Engineered Products, West wall of "lower shop area", On or about August 29th, 2018 and times prior thereto:  Employees were dispensing a category 2 flammable liquid (acetone) from a 55 gallon drum into secondary containers in order to clean metal parts.  The metal drum was not bonded to the smaller containers, during transfer, to provide dissipation of static electricity while dispensing the flammable liquid.
