OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls when standing on the forklift forks or on a pallet:    On or about August 31, 2018, employees were exposed to falls of approximately 12 feet 9 inches when they rode the forks of a Raymond fork lift to the top of a stack of boxes to look for and retrieve inventory.

On or about August 31, 2018, the employer failed to provide refresher training, including an evaluation of the effectiveness of that training, to an employee who was involved in a forklift related accident when an employee the operator had lifted approximately 12 feet 9 inches into the air on the forks fell when stepping back onto the forks to be brought back down.
