29 CFR 1926.602(d): The employer did not ensure that each employee operating a powered industrial vehicle had been trained and evaluated as required by paragraph 29 CFR 1910.178(l): Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178 and as referenced by the note contained in 1926.602(d). On or about 9/11/2018, BAM Contracting LLC had not ensured an employee was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the required training. A foreman, who had not been trained or evaluated, was operating a JLG Telehandler, Model G10-55A /Serial # 0160066113, to facilitate construction work on several buildings located at 100 Winghaven Pointe Drive in OFallon, MO.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about 9/11/2018, BAM Contracting LLC was working on the second floors on two units at the Altair at the Preserve Luxury Apartments located at 100 Winghaven Pointe Drive in OFallon, MO. Two foremen and one employee were wearing personal fall arrest systems, but were not tied off to the structure. BAM Contracting LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(1), which was contained in OSHA inspection number 985800 citation number 1, item number 2, issued on 8/05/2014, and was affirmed as a final order on 8/26/2014, with respect to a workplace located at the intersection of Cliff View Drive and Wentzville Bluffs Drive in Wentzville, MO.
