29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part. a. On or about September 12, 2018, located at 84 South Liberty Street in Powell, Ohio, the employer did not initiate and maintain safety and health programs for employees working at heights framing a townhouse, thereby exposing the employees to the hazards associated with framing construction.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a. On or about September 12, 2018, located at 84 South Liberty Street in Powell, Ohio, an employee was installing sub fascia while standing on the top of porch rafters without any means of fall protection, thereby exposing the employee to a fall hazard of approximately 10 feet.
