29 CFR 1917.26(f): A readily available portable or permanent ladder giving access to the water was not provided within 200 feet of the work area leading to a detached vessel berthing installation:  (a) On 9/10/2018, at the Pacific Oyster pier in Bay City, Oregon, employees were exposed to drowning hazards, in that they were using a floating dock where a ladder was not readily available if someone fell in the water. Employees were offloading oyster harvester boats.

29 CFR 1917.27(a)(1): Employees other than those determined by the employer to be competent through training or experience were permitted to operate a power operated vehicle:  (a) on 9/12/2018, a forklift driver on the pier at Pacific Oyster in Bay City, Oregon was observed operating a forklift in an unsafe manner in that he was backing up without looking where he was going and was talking on a cell phone while doing so.

29 CFR 1917.26(f): A US Coast Guard approved 30 inch life ring, with at least 90 feet of line attached, was not available at readily accessible points at each waterside work area where the employees' work exposed them to the hazard of drowning.    (a) On 9/12/2018, on the pier of Pacific Oyster in Bay City, Oregon, employees were exposed to drowning hazards, since they were working at a dock and pier where a life ring with 90 feet of line attached was not available. Workers were docking boats, loading and off-loading cargo and supplies, and handling oysters to be processed, on the dock, on the pier, and under the pier.  Pacific Seafood was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1917.26(f), which was contained in OSHA inspection number 1132545, citation number 1,item number 1 and was affirmed as a final order on April 18, 2016, with respect to a workplace located at 213 S.W. Bay Boulevard, Newport, OR 97420.
