29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a. On or about September 9, 2018, employees working above the 4th floor were installing and standing up roof trusses while walking on the wood trusses that were laying down, exposing the employees to a 9 foot fall hazard. b. On or about September 9, 2018, employees installing and standing up roof trusses were standing directly at the edge of the building, exposing the employees to a 42 foot fall hazard.

29 CFR 1926.502(k)(1): A fall protection plan was not prepared by a qualified person and developed specifically for the site where the leading edge work, precast work, or residential construction work was being performed: a. On or about Sept 14, 2018, at the jobsite, the employer directed subcontractor employees from Professional Building Services (PBS) and Reyes Family Construction Corp. to follow a written Fall Protection Program that was not designed specifically for the jobsite and the written program that was provided did not adequately address protecting employees from falling while engaged in residential construction.
