OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and struck-by hazards:       a) On or about September 17, 2018, employees were exposed to the hazard of being struck-by and/or crushed where safety barriers were not set up to protect the sides and rear areas of the swing pattern (swing areas and blind spots) of an excavator.            Among others, feasible and acceptable methods of abatement would include, setting up safety barriers to the sides and rear of the excavator's swing patterns to prevent anyone from walking into the working area as described in the Association of Equipment Manufacturers Safety Manual for Hydraulic Excavators.      In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation; item f (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:       a) On or about September 17, 2018, safe means of egress was not provided where work was conducted in a trench having a depth greater than 5 feet.     Crossroads Services, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1051(a) which was contained in OSHA inspection number 1248166, citation 1, item 4, and was affirmed as a final order on October 6, 2017, with respect to a worksite located at W. Creek Drive/Spring Creek Drive, Tinley Park, Illinois.        In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c):       a) On or about September 17, 2018, employees were not protected from the hazard of cave-ins by shoring, sloping, or other protective means while working in a trench having a depth of approximately 5'3".      Crossroads Services, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1) which was contained in OSHA inspection number 1248166, citation 1, item 3b, and was affirmed as a final order on October 6, 2017, with respect to a worksite located at W.
