Construction LLC on or about September 18, 2018 at the address of 3318 Chapel Creek, Perrysburg, Ohio: The employer did not have a plan or program to identify job site hazards which assists employees in maintaining a safe working environment.  Such programs would support the employer and employees in identifying and avoiding potential hazards, such as falls during job site operations, decreasing the probability of employee injury and/or illness.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards.   a) M.J.L. Construction LLC on or about September 18, 2018 at the address of 3318 Chapel Creek, Perrysburg, OH: The employer had not trained employees in the appropriate use of fall protection, such as but not limited to, the use of personal fall arrest systems while performing various roofing operations. The employees did not recognize the hazards associated with working from an elevated location without the benefit of fall protection.

29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  a) M.J.L. Construction LLC on or about September 18, 2018 at the address of 3318 Chapel Creek, Perrysburg OH: The employer failed to ensure that an employee operating a fork truck was adequately trained. Employees working near or around untrained operators were exposed to struck-by injuries, while elevating building material to the top deck of the structure for employees to handle.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.  a) M.J.L. Construction LLC on or about September 18, 2018 at the address of 3318 Chapel Creek, Perrysburg, Ohio: The employer did not ensure employees were protected from falls while installing OSB sheeting to trusses of residential structure. Employees were exposed to a potential 14 foot fall to the level below.                 M.J.L. Construction LLC was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501 (b)(13), which was contained in OSHA inspection number 976448, citation number 1, item number 2 and was affirmed as a final order on July 10, 2014, with respect to a workplace located at 8713 Palermo, Monclova, Ohio.
