29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person.  A) M.J.L. Construction LLC on or about March 27, 2019, at the address of 102 Forest Gate Lot #13, Perrysburg, OH: The employer did not ensure the scaffolding platform (Wood Pallet) used to elevate employees via forklift, was designed by a qualified person. An employee installing fascia board in this condition was exposed to a fall of approximately 18 feet.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level were not protected from falling to that lower level.  A) M.J.L. Construction LLC on or about March 27, 2019 at the address of 102 Forest Gate Lot #13, Perrysburg, OH: The employer did not ensure employees were protected from falls while working from a job made scaffold platform.  The employee was exposed to a 11ft fall to the level below while installing fascia to the residential structure.  B) M.J.L. Construction LLC on or about March 27, 2019 at the address of 102 Forest Gate Lot #13, Perrysburg, OH: The employer did not ensure employees were protected from falls while working from a rough terrain fork lift platform (pallet) platform.  The employee was exposed to a 18ft fall to the level below while installing fascia to the residential structure.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet.  a) M.J.L. Construction LLC, on or about March 27, 2019 at the address of 102 Forest Gate Lot # 13, Perrysburg, Ohio: The employer did not ensure the side rails of the 24 feet aluminum extension ladder was extended at least three feet above the landing surface. One employee was exposed to falls while using the ladder to access the job made scaffold.

29 CFR 1926.20(b)(1): The employer does not initiate and maintain accident prevention programs as necessary to comply with this part.  A.) M.J.L. Construction LLC does not have a plan or program to identify job site hazards which assists employees in maintaining a safe working environment.  Such programs would support the employer and employees in identifying and avoiding potential hazards, such as falls during job site operations, decreasing the probability of employee injury and/or illness. The most recent violation was observed on or about March 27, 2019 at the address of 102 Forest Gate Lot #3, Perrysburg, Ohio.  M.J.L. Construction LLC was previously cited for a violation of this occupational safety and health standard 1926.20(b)(1), which was contained in OSHA inspection number 1347158, citation number 1, item number 1a, and was affirmed as a final order on November 29, 2019, with respect to a workplace located at 3318 Chapel Creek, Perrysburg, Ohio.

29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.   A) M.J.L. Construction LLC does not require employees operating fork trucks to be adequately trained. The violation was most recently observed on or about March 27, 2019 at the address of 102 Forest Gate Lot #3, Perrysburg, Ohio.  Employees working near or around untrained operators are exposed to struck-by injuries, while elevating building material to the top deck of the structure for employees to handle.   M.J.L. Construction LLC  was previously cited for a violation of this occupational safety and health standard 1910.178(l)(2)(ii), which was contained in OSHA inspection number 1347158 , citation number 1, item number 2 and was affirmed as a final order on November 29, 2019, with respect to a workplace located at 3318 Chapel Creek, Perrysburg, Ohio.
