29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years:  At the location of 7121 W. 135th St., in Overland Park KS, an employee engaged in operating an all-terrain forklift (Model Lull 1044C54 Series II #34848) and workers near the forklift were exposed to struck-by hazards in that the operator driving the forklift had not completed at least a 3 year evaluation.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  At the location of 7121 W. 135th St., in Overland Park KS, an employee engaged in removing construction material from a pallet on the forks of a Lull was exposed to fall hazards of approximately 40 feet to the ground below in that a complete fall protection system was not in use.
