29 CFR 1910.29(b)(13): When guardrail systems are used around holes that serve as points of access (such as ladderways), the guardrail system opening did not meet the requirements (b)(13)(i) or (b)(13)(ii) of this section, such as self-closing gates or offset platforms.  On or about 25 September 2018, and at times prior thereto, guardrail systems at the top of vessels did not effectively close the ladderway openings with either gates or offsets, exposing workers to a fall hazard of up to approximately 15 feet to the concrete grade below. a) Sodium Hydroxide (NaOH) Tank, Vessel U2101, did not have a gate or offset at the ladderway opening, exposing personnel to a fall of approximately 13 feet to the concrete grade. b) Sulfuric Acid Tank, Vessel U2103, did not have a gate or offset at the ladderway opening, exposing personnel to a fall of approximately 15 feet to the concrete grade. c) Sulfuric Acid Tank, Vessel U2102, did not have a gate or offset at the ladderway opening, exposing personnel to a fall of approximately 15 feet to the concrete grade. d) Phosphoric Acid Tank, Vessel U2107, did not have a gate or offset at the ladderway opening, exposing personnel to a fall of approximately 13 feet to the concrete grade. e) Argon Fluoride (ArF) Thinner Collection Tank, Vessel U2106, did not have a gate or offset at the ladderway opening, exposing personnel to a fall of approximately 13 feet to the concrete grade. f) Sulfuric Acid Tank A did not have a gate or offset at the ladderway opening, exposing personnel to a fall of approximately 13 feet to the concrete grade. g) CuWW Dilute Copper Waste Tank, Vessel U35B, did not have a gate or offset at the ladderway opening, exposing personnel to a fall of approximately 12 feet to the concrete grade.

29 CFR 1910.119(l)(1): The employer did not implement procedures to manage changes to process chemicals, technology, equipment, and procedures, and changes to facilities that affect a covered process.  On or about 25 September 2018, and at times prior thereto, the employer did not implement management of change procedures for a change in process chemicals within the Fab 2 Base Room.

29 CFR 1910.147(c)(2)(ii): An energy isolating device that was capable of being locked out, did not utilize a lockout device, which rendered the machine or equipment inoperative.  On or about 25 September 2018, and at times prior thereto, repair work on the main exhaust lines running through the sub fabs did not include lock-out of the lines and the equipment upstream and downstream, exposing the workers to the hazards of Hydrogen Fluoride (HF) gas.
