29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system:  a) Site - On or about 09/26/18 and at times prior thereto employees were working/cleaning inside the porches in the fourth level in proximity of the unprotected balcony borders, and were exposed to 33 ft. falls to ground level.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  (Construction Reference: 1926.59).  a) Site - On or about 09/29/19 and at times prior thereto employees prepared and applied stucco and came in contact with silica and Portland cement. The employer did not prepare and implement a written hazard communication program.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(g)(8):   The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical  a) Site - On or about 09/29/19 and at times prior thereto employees prepared and applied stucco and came in contact with silica and Portland cement. The employer did not maintain copies of the safety data sheets for each  chemical at the worksite.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
