29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: a) Troy Forming Concrete Inc., 7196 East Archer Place, Denver, CO 80230: On or before 09/28/2018, the exposing employer did not ensure a competent person was conducting frequent inspections to identify and correct hazardous conditions capable of causing injury. Employees on location were working installing formwork in an excavation greater than 5 feet in depth with noticeable fissures on the northeast corner vertical wall of the excavation. No daily inspections of the jobsite were being performed exposing employees to safety hazards when working in and around excavations. Note: OSHA defines a "competent person" as someone capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to workers, and who has authorization to take prompt corrective measures to eliminate them.
