29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:  (a) Troy Forming Concrete Inc. at 835 Colorado River Ave, Brighton, CO: On and before June 14, 2019, the exposing employer did not ensure that the spoil pile  was at least 2 feet from the edge of the excavation. One employee worked to install a sewer line in the bottom of the northern excavation, which was approximately 3 feet wide and 14.5 feet in depth with type B soil and almost vertically sloped excavation walls. The spoils pile was located to the northwest of the north excavation, was not separated from the excavation, and measured approximately 7.8 feet in height. This condition exposed the employee to the hazard of spoil pile material falling into the excavation or causing the excavation wall to collapse.    (b) Troy Forming Concrete Inc. at 835 Colorado River Ave, Brighton, CO: On and before June 14, 2019, the exposing employer did not ensure that the spoil pile  was at least 2 feet from the edge of the excavation. One employee worked to install a sewer line in the bottom of the southern excavation which was approximately 3 feet wide and 11 feet in depth with type B soil and almost vertically sloped excavation walls. The spoils pile was located to the southwest of the south excavation, was not separated from the excavation, and measured approximately 8.2 feet in height. This condition exposed the employee to the hazard of spoil pile material falling into the excavation or causing the excavation wall to collapse.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):     (a) Troy Forming Concrete Inc. at 835 Colorado River Ave, Brighton, CO: On and before June 14, 2019, the exposing employer did not ensure that an employee, who was installing a sewer line at the bottom of the northern excavation, which measured approximately 3 feet wide and 14.5 feet in depth, was protected from cave-in.  The employer used approximately vertical sloping of the excavation walls to protect employees. The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i), in that the maximum allowable slope associated with Type B soil is an angle of 45 degrees, from toe to top.  The condition exposed employees to a crushing hazard by excavation wall cave-in.      (a) Troy Forming Concrete Inc. at 835 Colorado River Ave, Brighton, CO: On and before June 14, 2019, the exposing employer did not ensure that an employee, who was installing a sewer line at the bottom of the southern excavation, which measured approximately 3 feet wide and 11 feet in depth, was protected from cave-in. 29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:    (a) Troy Forming Concrete Inc. at 835 Colorado River Ave, Brighton, CO: On and before June 14, 2019, the exposing employer did not ensure that inspections of the excavation were conducted by a competent person as needed during an excavation for installation of the sewer line. Two employees, an equipment operator and pipe fitter, conducted the digging of the northern excavation but were not competent persons for excavation inspections. The pipe fitter entered the bottom of the northern excavation, which was approximately 3 feet wide and 14.5 feet in depth with type B soil and almost vertically sloped excavation walls, to locate the sewer connection and to level the bottom of the excavation for assembling piping. The condition exposed an employee to a crushing hazard by excavation wall cave-in.      (b) Troy Forming Concrete Inc. at 835 Colorado River Ave, Brighton, CO: On and before June 14, 2019, the exposing employer did not ensure that inspections of the excavation were conducted by a competent person as needed during an excavation for installation of the sewer line.
