29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a.   On or about October 1, 2018, at the construction site located at Lot 60 Wellington Park, Pickerington, Ohio, the employer failed to maintain a safety and health program to ensure hazard detection and correction.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  a.   On or about October 1, 2018, at the construction site located at Lot 60 Wellington Park, Pickerington, Ohio, the employer failed to instruct each employee in the avoidance of unsafe conditions while performing construction activities.

17, 20129 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   a.   On or about October 1, 2018, at the construction site located at Lot 60 Wellington Park, Pickerington, Ohio, an employee was performing framing work on a lower level porch roof of a two story residential home with a pitch of approximately 4 in 12 and approximately 8 feet in height with no fall protection, thereby exposing the employee to a fall hazard.  b.   On or about October 1, 2018, at the construction site located at Lot 60 Wellington Park, Pickerington, Ohio, an employee was installing weather barrier to the exterior of the home from a second story window opening at approximately 15 feet in height with no fall protection, thereby exposing the employee to a fall hazard.
