29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59) Employees engaged in roofing activities were exposed to injury/illness from dermal, ingestion, and inhalation hazards from exposure to hazardous chemicals. The employer had not developed or implemented a written hazard communication program to ensure that employees were aware of the hazards associated with the chemicals with which they work. Hazardous chemicals used at the site included but were not limited to gasoline.

29 CFR 1910.1200(g)(8): The employer did not maintain copies of the required material safety data sheets for each hazardous chemical in the workplace: (Construction Reference: 1926.59) Employees engaged in roofing activities were exposed to injury/illness from dermal, ingestion, and inhalation hazards from exposure to hazardous chemicals. A copy of the required safety data sheet for gasoline was not maintained at the residential construction site. Employees were using gasoline to fuel an air compressor.
