29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder:    a)  Vicinity of True Value Hardware, Village of Taunton Forge:  The side rails of the base section of a Werner Model D1216-2 Type II Medium Duty Aluminum Extension ladder used by an employee to get on to and off of the roof overhang, approximately 10 feet 2 inches above the concrete sidewalk, only extended approximately 4-8 inches above the upper landing surface being access, on or about 10/01/2018;    b)  Vicinity of True Value Hardware, Village of Taunton Forge:  The side rails of the base section of a Werner Model D1216-2 Type II Medium Duty Aluminum Extension ladder used by an employee to get on to and off of the roof overhang, approximately 10 feet 2 inches above the concrete sidewalk, did not extend above the upper landing surface being access, on or about 10/02/2018;    c)  Vicinity of True Value Hardware, Village of Taunton Forge:  The side rails of the base section of a Werner Model D1216-2 Type II Medium Duty Aluminum Extension ladder used by an employee to get on to and off of the roof overhang, approximately 10 feet 2 inches above the concrete sidewalk, only extended approximately 20 inches above the upper landing surface being access, on or about 10/02/2018;    d)  Vicinity of True Value Hardware & Breakthru Physical Therapy, Village of Taunton Forge:  The side rails of the base section of a Werner Model D1216-2 Type II Medium Duty Aluminum Extension ladder used by employees to get on to and off of the roof overhang, approximately 10 feet 2 inches above the concrete sidewalk, only extended approximately 20 inches above the upper landing surface being access, on or about 10/04/2018.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
