29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. On or about October 11, 2018, located at 6951 Canon Drive, Canal Winchester, Ohio, the employer did not maintain a safety and health program to ensure hazard detection and correction while performing roofing work at the new-home residential construction site.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a. On or about October 11, 2018, located at 6951 Canon Drive, Canal Winchester, Ohio, the employer did not ensure that employees performing work onsite were protected from falls, thereby exposing the employee to a fall hazard from approximately 14 feet 9 inches.
