OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards:    a) Warehouse  -  Sufficient safe clearances did not exist in floor level storage rack bays where employees operate Crown PC 4500 pallet trucks to make case picks.  The first horizontal rack beam in aisle 2M had a height of 59 inches from the floor to the bottom of the beam.  The Crown pallet truck had an open operator compartment with sides that extended 37 inches above the floor, which would allow the horizontal rack beam to enter the operator's compartment, pinning the operator between the beam and the backrest of the material handling equipment, as happened on or about October 11, 2018.    Abatement certification and documentation required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.  Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace:    a) Warehouse - The employer did not conduct an evaluation of an operator's performance prior to permitting them to operate a Crown PC4500-60 pallet truck, on or about October 1, 2018.    No abatement certification or documentation required.

29 CFR 1910.178(l)(3)(ii)(I): Powered industrial truck operators did not receive training on unique or potentially hazardous environmental conditions in the workplace that could affect safe operations:     a)  Warehouse - The employer failed to train employees on crushing and pinning injuries associated with under-ride hazards while operating Crown PC4500 pallet jacks next to horizontal rack beams in the new 3M warehouse.  The configuration of the horizontal rack crossbars could enter the open operators compartment, on or about October 11, 2018.     Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
