29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection was not provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: a) Proposed manhole at intersection of Cass & Carew Streets., Springfield, MA: On or about October 10, 2018, two employees were observed working in this unprotected excavation which had a 47,400 pound excavator parked straddling the edge of this excavation. Specific abatement documentation that this violation has been corrected must be provided within 10 days of the abatement in accordance with 29CFR1903.19(d)(1).

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system: The employer does not protect its employees from cave-in hazards while working in excavations. This was most recently observed on or about October 10, 2018 at a worksite located at the proposed manhole at Cass and Carew Streets., Springfield, MA in that two employees were observed working in this excavation without any cave-in protection: (a) Two employees were observed working in this unprotected excavation which was greater than 6 feet deep without any protective system. To abate this violation, the employer must ensure that all its employees use cave-in protection for all excavations requiring its use, train them in the proper usage and enforce that usage when employee are working in excavations where such cave-in protection is required by the standard. The employer was cited for a repeat violation of this standard, 29 CFR 1926.652 (a) 1 in OSHA inspection number 941682 Item 2, Number 1, which was final order on November 4, 2013 with relation to a worksite at 78 Harrison Ave., Orange, MA. Specific abatement documentation that this violation has been corrected must be provided within 10 days of the abatement in accordance with 29 CFR 1903.19 (d)(1).
