29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program: a.) An oven operator was exposed to occupational noise at a level of 91.6 dBA as an 8-hour Time-Weighted Average during a sampling period of 329 minutes, as revealed by monitoring conducted by OSHA on October 16th, 2018. The employer had not conducted noise monitoring for this position. Zero exposure was assumed for the unsampled portion of the shift. b.) An oven operator was exposed to occupational noise at a level of 87.3 dBA as an 8-hour Time-Weighted Average during a sampling period of 313 minutes, as revealed by monitoring conducted by OSHA on October 16th, 2018. The employer had not conducted noise monitoring for this position. Zero exposure was assumed for the unsampled portion of the shift.

29 CFR 1910.1200(h)(3)(iv): The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer: Employees were exposed to chemicals such as Jasco methyl ethyl ketone (flammable liquid/burns) and KJ-1525 Wash-up (flammable liquid/burns) and the employer did not ensure that employees received adequate training in that employees were not trained on labeling used in the workplace including global harmonized system pictograms and USDOT HazMat placards.
