OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees working at or near dry dust collection systems (indoor enclosureless bag separator and upstream ducting) handling combustible wood dust were exposed to wood dust fire hazards during the operation and maintenance of the dust collection system:    a)  An indoor enclosureless bag separator (Dustek M1500 Dust Collection System) with positive pressure air-material inlet and four unenclosed dust filter bags was used to collected combustible wood dust fines from a Shoda High Speed NC Router and two Crouch Pedestal Drum sanders. Employees were exposed to the hazards of fire and flash fire from working in close proximity to the indoor enclosureless dust collector and upstream ducting and manually emptying the bags of collected combustible wood dust in the event of the presence of an internal fire, ember or spark.    b)  An indoor enclosureless bag separator (Dustek C1500 Dust Collection System) with positive pressure air-material inlet and four unenclosed dust filter bags was used to collected combustible wood dust fines from a Timesavers Wide Belt Sander, a Shoda High Speed NCW Router, a Biesse Rover CNC and a Powermatic saw. Employees were exposed to the hazards of fire and flash fire from working in close proximity to the indoor enclosureless dust collector and upstream ducting and manually emptying the bags of collected combustible wood dust in the event of the presence of an internal fire, ember or spark.    c)  Three indoor enclosureless bag separators (Dustek Dust Collection Systems) with positive pressure air-material inlet and four unenclosed dust filter bags was used to collected combustible wood dust fines from different types of wood working equipment. Employees were exposed to the hazards of fire and flash fire from working in close proximity to the indoor enclosureless dust collector and upstream ducting and manually emptying the bags of collected combustible wood dust in the event of the presence of an internal fire, ember or spark.

29 CFR 1910.107(c)(6):  Electrical wiring and equipment not subject to deposits of combustible residues but located in a spraying area as herein defined shall be of explosion-proof type approved for Class I, group D locations and shall otherwise conform to the provisions of subpart S of this part, for Class I, Division 1, Hazardous Locations. Electrical wiring, motors, and other equipment outside of but within twenty (20) feet of any spraying area, and not separated therefrom by partitions, shall not produce sparks under normal operating conditions and shall otherwise conform to the provisions of subpart S of this part for Class I, Division 2 Hazardous Locations:    Electrical wiring and equipment located in the spray area where red adhesive F-150 and F-151 (flammable - category 2) was being sprayed were not of explosion-proof type approved for Class I, group D locations and did not conform to the provisions of subpart S of this part, for Class I, Division 1, Hazardous Locations. Electrical equipment such as, but not limited to: 1) electrical outlets, breaker panels and a heater control were located within 20 feet (horizontally) of the spray area; and 2) electrical pendant outlets with retractable extension cords were located within 10 feet (vertically) of the spray area.
