29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):    (a)  A & J Construction Company Inc., at 5959 N Dunkirk St., Denver, CO:  On and preceding 10/12/18,  the employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person.  Subcontractor employees were installing exterior sheathing on a two-story multi-family residential structure by leaning out wall openings.  An employee connected to a lanyard fell approximately 11 feet to the ground when a guardrail failed.  The employer did not ensure that the subcontractor was following safe work practices, in that subcontractor employees were leaning out wall openings, were not maintaining the proper slack in the personal fall arrest system, and that the guardrails were properly installed.  This condition exposed subcontractor employees to fall hazards.
