29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and material safety data sheets.   On October 18,2018 and prior to, the employer did not provide effective training on the hazardous flammable chemicals such as but not limited to; Tnemec Protective Coating N140, V14A part A and part B in that located at the company on site paint storage trailer employee(s) who had not received effective information and training on the flammability associated hazards of the chemicals were utilizing a 110v electric drill with mixer attachment for mixing the flammable paint at that location and were working within the trailer where there was a 110v space heater observed in operation heating at least 12 filled 5 gallon metal containers of flammable Tnemec Protective Coating N140, V14A part A and part B. The 12 filled, 5 gallon containers additionally had a combustible partial paper enclosure around the containers to filter the heat to the containers and the operational space heater is within two feet of the containers.

29 CFR 1926.403(i)(2)(i): Except as required or permitted elsewhere in this subpart, live parts of electric equipment operating at 50 volts or more shall be guarded against accidental contact by cabinets or other forms of enclosures, or by any of the following means: (A) By location in a room, vault, or similar enclosure that is accessible only to qualified persons. (B) By partitions or screens so arranged that only qualified persons will have access to the space within reach of the live parts. Any openings in such partitions or screens shall be so sized and located that persons are not likely to come into accidental contact with the live parts or to bring conducting objects into contact with them. (C) By location on a balcony, gallery, or platform so elevated and arranged as to exclude unqualified persons. (D) By elevation of 8 feet (2.44 m) or more above the floor or other working surface and so installed as to exclude unqualified persons.     On October 18, 2018 and prior to, located within the fenced area surrounding the elevated water tower storage tank employees were utilizing an observed energized minimum 110 volt electric circuit breaker box in which two of the circuit breakers positions are open, not equipped with circuit breakers and not equipped with filler plates for the unfilled openings exposing employees energized live parts of electric equipment operating at 110 volts which were not guarded against accidental contact.

On October 18, 2018 and prior to, located within the fenced area surrounding the elevated water tower storage tank between a minimum 110 volt circuit breaker box powering an attached energized two-way 110 volt circuit receptacle to the company on site paint storage trailer there is an observed in operation orange 3 way energized extension cord with a missing grounding pin being utilized powering attached in line damaged extension cords, 110 volt space heater in operation and a 110v drill with mixer attachment for mixing the flammable paint.

29 CFR 1926.405(g)(2)(iii): Flexible cords shall be used only in continuous lengths without splice or tap. Hard service flexible cords No. 12 or larger may be repaired if spliced so that the splice retains the insulation, outer sheath properties, and usage characteristics of the cord being spliced.     On October 18, 2018 and prior to, located within the fenced area surrounding the elevated water tower storage tank between a minimum 110 volt electrical circuit breaker box with attached energized two-way 110 volt circuit receptacle to the company on site paint storage trailer there is an observed operational blue flexible extension cord which has an approximate one foot section of electrical tape covering a wire nut splice. The blue flexible extension cord is plugged into and powering orange flexible extension cord. The orange flexible cord is also spliced together with wire nuts, one of the wire nuts is exposed on one end and otherwise electrical taped between the spliced sections with the exception of the end of the one wire nut which is not insulated with electrical tape. Both the blue and orange flexible extension cords are not a continuous length without splice or tap and the repaired electrical tape splices do not retain the insulation, outer sheath properties, and usage characteristics of the cords being spliced.
