29 CFR 1910.106(e)(2)(ii)(b): The quantity of liquid that may be located outside of an inside storage room or storage cabinet in a building or in any one fire area of a building shall not exceed: (1) 25 gallons of Category 1 flammable liquids in containers (2) 120 gallons of Category 2, 3, or 4 flammable liquids in containers (3) 660 gallons of Category 2, 3, or 4 flammable liquids in a single portable tank. a) Prodigy Boats, Jasper, GA - Employees were exposed to a fire hazard. On or about 10/19/2018, and times prior to,there was an accumulation of flammable and combustible liquids within a wooden storage room and/or the production area that exceeded that which is allowed. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): Prodigy Boats, LLC - Employees used chemicals such as, but not limited to xylene, welding fumes, paints, lacquer thinner, and promoters, etc. On or about 10/19/2018, and at times prior to, the employer failed to ensure a hazard communication program was implemented that identified hazardous chemicals and adequately informed employees of the hazards associated with those chemicals. The hazard communication program was not found on site and not available for employees to review. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.95(k)(1): The employer did not train each employee who is exposed to noise at or above an 8-hour time-weighted average of 85 decibels in accordance with the requirements of 29 CFR 1910.95(k). The employer did not institute a training program and ensure employee participation in the program: a) Prodigy Boats LLC, Jasper, GA - An employee was exposed to noise levels at a time-weighted average (TWA) of 88.4 dBA, which exceeded action level of 85 dBA. A training program for noise in accordance with the standard was not instituted, on or about 01/04/19. b) Prodigy Boats LLC, Jasper, GA - An employee was exposed to noise levels at a time-weighted average (TWA) of 91.6 dBA, which exceeded action level of 85 dBA. A training program for noise in accordance with the standard was not instituted, on or about 01/04/19. b) Prodigy Boats LLC, Jasper, GA - An employee was exposed to noise levels at a time-weighted average (TWA) of 90.7 dBA, which exceeded action level of 85 dBA. A training program for noise in accordance with the standard was not instituted, on or about 01/04/19. Prodigy Boats, LLC was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1910.95(k)(1), which was contained in OSHA inspection number 1087682 and 1134396, citation number 1, item number 3 and was affirmed as a final order on 10/28/2015 and 08/03/2016, with respect to the workplace located at 89 Chambers Industrial Drive, Jasper, GA, 30143.
