29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph of 1926.501(b). The employer is failing to ensure that all employees are protected from fall hazards when performing roofing operations. This event was most recently documented at the jobsite located at 21989 Brookside Ave. Elkhorn, NE 68117 on October 24, 2018. Three individuals were working on the roof of a residential structure without utilizing fall protection. The employees were exposed to falls of over 11 feet and 2 inches to the concrete driveway below. The roof pitch was observed at the following pitches: 6:12 and 10:12.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed. The employer is failing to ensure that all employees are protected from fall hazards when entering and exiting the landing surface of a residential roof. This event was most recently documented at the jobsite located at 21989 Brookside Ave. Elkhorn, NE 68117 on October 24, 2018. Three employees were using a twenty-eight foot extension ladders to enter and exit the roof. This ladder did not have the side rails extended to at least three feet above the landing surface on the edge of the lower level of the roof. The ladder was extended to two feet above the eve. The ground to eave height of this house measured approximately 11 feet and 2 inches.

29 CFR 1926.1060(a): The employer shall provide a training program for each employee using ladders and stairways, as necessary. The program shall enable each employee to recognize hazards related to ladders and stairways, and shall train each employee in the procedures to be followed to minimize these hazards. The employer failed to protect the employees from fall hazards while utilizing ladders by providing ladder training. This was most recently documented at the jobsite located at 21989 Brookside Ave. Elkhorn, NE 68117 on October 24, 2018. The employer is failing to train employees to recognized fall hazards associated with the proper use and placement of ladders.
