29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress were not located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees: (a)S. J. Louis Construction, Inc. at 1908 South Dakota Highway 50, Yankton, SD 57078: On or about and at times prior to October 12, 2018, the employer did not ensure employees were protected from cave-in hazards in that, a safe means of egress was not made available to employees that had to perform hand digging to locate a fiber optic cable on the south side of the excavation. Employees performed work in an excavation at an approximate depth of 8 feet without a safe means of egress. This condition exposed employees to cave-in hazards.

Louis Construction, Inc. at 1908 South Dakota Highway 50, Yankton, SD 57078: On or about and at times prior to October 12, 2018, the employer did not ensure employees were protected from struck-by hazards in that, the team leader/foreman onsite did not wear a warning vest or other suitable garments marked with or made of reflectorized or high-visibility material when exposed to public vehicular traffic. This condition exposed one employee to struck-by hazards.

29 CFR 1926.652(a)(1): Each employee in an excavation were not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when: (a)S. J. Louis Construction, Inc. at 1908 South Dakota Highway 50, Yankton, SD 57078: On or about and at times prior to October 12, 2018, the employer did not ensure employees were protected from cave-ins by an adequate protective system. Employees were hand digging to locate a fiber optic cable on the south side of an excavation approximately 8 feet in depth without an adequate protective system. This condition exposed employees to cave-in hazards. S. J. Louis Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 627118, citation number 1, item number 3 and was affirmed as a final order on October 8, 2014, with respect to a workplace located at River Road & Fraine Barracks Road, Bismark, ND 58501.

29 CFR 1926.651(k)(2): Where the competent person finds evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: (a)S. J. Louis Construction, Inc. at 1908 South Dakota Highway 50, Yankton, SD 57078: On or about and at times prior to October 12, 2018, the employer did not remove employees from an excavation with a depth greater than five feet that were not utilizing an adequate protective system where employees were performing hand digging to locate a fiber optic cable. This condition exposed employees to cave-in hazards. S. J. Louis Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.651(k)(2), which was contained in OSHA inspection number 627118, citation number 1, item number 2 and was affirmed as a final order on October 8, 2014, with respect to a workplace located at River Road & Fraine Barracks Road, Bismark, ND 58501.
