29 CFR 1910.178(l)(4)(ii)(B): Refresher training, including an evaluation of the effectiveness of that training, was not provided to the operator when the operator has been involved in an accident or near-miss incident: (a) On or about October 15, 2018, employees were involved in a forklift accident. The employer did not ensure that the forklift operator was retrained after the accident. This exposed employees working around the forklift operator to struck by hazards.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: (a) Employees were exposed to laceration/amputation hazards while working on and around the Kalamazoo Horizontal Band Saw(Model #H9AD and Serial #10.549). The employer did not ensure the unused portion of the blade was properly guarded.
