29 CFR 1910.147(c)(7)(i)(A): Authorized employee(s) did not receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control: a) On or about October 25, 2018, at the above located workplace, the employer did not provide effective training to each authorized employee who performed cleaning on the Rheon, V4 Free Divider with Cross Roller, Model VX122 machine. A sanitation employee did not lockout the machine but used magnets to bypass interlocks to operate the machine during cleaning. The employee was thereby exposed to hazards associated with moving parts and the unexpected start-up of the machine.

29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1) through (d)(6): a) On or about October 25, 2018, at the above located workplace, sanitation employees were exposed to machine hazards associated with moving parts and ingoing nip points during servicing and cleaning of the Rheon, V4 Free Divider with Cross Roller, Model VX122 machine. The employer failed to implement energy control application steps as the machine was not shut down or turned off to perform the servicing work [per the 1910.147(d)(2) requirements]. As a result, the remaining applicable energy control elements, involving machine isolation [(d)(3)], LOTO device application [(d)(4)], dissipation of residual energy [(d)(5)(i)], and verification of isolation [(d)(6)], were not implemented to protect employees from machine servicing and cleaning hazards.

The employer did not conduct and certify an annual or more frequent inspection of the energy control procedures to ensure that the procedures and requirements of this standard were followed. The employees were thereby exposed to hazards associated with moving parts. J & J Snack Foods Corp. was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1910.147(c)(6)(i), which was contained in OSHA inspection number 1219852, citation number 1, item number 1 and was affirmed as a final order on June 1, 2017, with respect to a workplace located at 720 Metropolitan Pkwy., Atlanta, GA. J & J Snack Foods Corp. was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1910.147(c)(6)(i), which was contained in OSHA inspection number 1099635, citation number 1, item number 3, and was affirmed as a final order on May 3, 2016, with respect to a workplace located at 720 Metropolitan Pkwy., Atlanta, GA.
