29 CFR 1910.28(b)(8): For repair pits, service pits, or assembly pits that were less than 10 feet (3 m) deep when fall protection systems were not required, the employer did not comply with provisions (i)-(iii) of this section: (a) On or about October 30, 2018, and at times prior, employees working in the express lube department were exposed to fall hazards of five feet into service pits where the employer did not mark or otherwise indicate the hazard or limit access, and a fall protection system was not in place. Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Certification of Corrective Action Worksheet"). In addition to the provisions listed in this section, acceptable abatement includes the use of conventional fall protection (such as guardrails) or safety net systems used in accordance with 29 CFR 1926 Subpart M.

29 CFR 1910.212(b): Machine(s) designed for fixed location(s) were not securely anchored to prevent walking or moving: a) On or about October 30, 2018, and at times prior, employees were exposed to injuries in that machines, located in the automotive shop, were not securely anchored: 1) Two Coats Tire Machines, serial numbers illegible, located in front area of automotive shop 2) Coats Tire Machine, serial number illegible, located in the northwest corner of automotive shop 3) Hunter flat tire changer, serial #00879, located near the northwest corn of the automotive shop Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Certification of Corrective Action Worksheet").
