29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    a) Exterior Front of DPW Garage: An employee was operating a JLG Telehandler forklift truck (Model G6-42A) without completing initial training and evaluation. The employer did not ensure that employees were trained and evaluated prior to operating powered industrial equipment, on or about 10/31/18.

29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied:  a) Exterior Front of DPW Garage: A JLG Telehandler forklift truck (Model G6-42A) with a wood pallet was attached to the trucks forks and used to transport an employee to the garage's roof level, that was approximately 25 feet above the ground surface, on or about 10/31/18.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  a) Exterior Front of DPW Garage: An employee transitioning from the forks of a JLG Telehandler forklift (Model G6-42A) to the leading edge of the roof was exposed to a fall hazard of approximately 25 feet above the ground surface without the use of a personal fall arrest system. The employer did not ensure that employees working at elevated heights greater than 6 feet above the ground surface, were provided with a personal fall arrest system, thus exposing employees to a fall hazard, on or about 10/31/18.  b) Exterior Front of DPW Garage: An employee engaged in retrieving lumber material and other equipment from the leading edge of the roof was exposed to a fall hazard of approximately 25 feet above the ground surface without the use of a personal fall arrest system tied off to an anchoring point. The employer did not ensure that employees working at elevated heights greater than 6 feet above the ground surface, were provided with a personal fall arrest system, thus exposing employees to a fall hazard, on or about 10/31/18.
