OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing hazards: a) 89 Maskells Mill Road, Salem NJ, Employees were removing the lowest two courses of a masonry block wall and replacing them with new masonry blocks. They did not brace the masonry blocks that were above those courses. They were exposed to being struck by the upper portions of the wall. An employee was struck and killed when the masonry block wall, above where he was working, broke free and fell onto him. Occurred on or about 10/31/2018. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) 89 Maskells Mill Road, Salem NJ, Employees were not trained in the barcaing of masonry walls when removing and replacing multiple courses of a masonry block wall and replacing them with new masonry blocks. Observed on or about 10/31/2018 NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
