29 CFR 1910.95(c)(1):  A continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (n) was not instituted when employee noise exposures equaled or exceeded an 8-hour time-weighted average sound level (TWA) of 85 dBA:       In the poly wrap department, where employees were exposed to continuous noise level at 84.9% of the allowable 8-hour time-weighted average sound level (85 dBA). The equivalent dBA level of 84.9% is approximately 89 dBA. The sampling was performed for 435 minutes during one shift on November 14, 2018.

29 CFR 1910.134(k): The employer did not provide the information on respirators in accordance to Appendix D of the section to employees who wear respirators when not required by this section or by the employer to do so:       In the manufacturing facility, the employer did not ensure that employees using 3M N95 particulate respirators were provided copy of Appendix D. Employees were potentially exposed to respiratory hazards when performing tasks such as, but not limited to filling metal pipes with foam containing Isocyanate.

29 CFR 1910.151(c): Where the eyes and body of any person may be exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body was not provided within the work area for immediate emergency use:       In the T Fab and the poly wrap areas of the manufacturing facility, employees using corrosive chemicals were not provided with an eye wash station within the spray area for immediate flushing of the eyes in an emergency, exposing employees to eye and skin injuries.

29 CFR 1910.179(l)(3)(iii)(d): Pendant control stations were not kept clean nor were function labels kept legible:      1. In the T Fab North crane area, the pendant controls to the Lift Tech 10-ton overhead crane was not kept clean and legible, exposing employees to being struck by suspended loads 4000-6000lb.      2. In the Weld South East area, the pendant controls to the Coffing 2-ton overhead crane was not kept clean and legible, exposing employees to being struck by suspended loads 1500-1800lb.    Section 5(a)(l) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by and/or crushed-by hazards:      a) In the T Fab area South Crane area, the pendant control to the Lift Tech Shaw Box 3-ton chain hoist being used to move pipes 3000-4000lb. did not have legible function labels.      b) In the T Fab area North Crane area, the pendant control to the Lift Tech Shaw Box 2-ton chain hoist being used to move pipes did not have legible function labels.

29 CFR 1910.212(a)(1):  Machine guarding was not provided to protect operator(s) and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks;                                                                                                                                                                                                                         a. In the Union Weld shop, employees operated Dayton 20 drill press model # 3Z919E s/n not legible exposed to amputation and laceration hazards.    b. In the production area by the welding area, employees operated a Westward 20 drill press s/n 09403530 model # 1KEN7 with no guard over rotating parts exposed to amputation and laceration hazards.    c. In the South crane area, employees operated Band Saw s/n and model not legible with the guard in full upright position installed exposing employees to struck by flying splinters and fingers and hands making contact with rotating blade on cutting band saw.      d. In the Weld area, employees operated Forrest Saw s/n 18150 model number 204 with no guard installed exposing employees to struck by flying splinters and fingers and hands making contact with rotating blade on cutting band saw.
