29 CFR 1926.1101(g)(7)(i): All Class II work was not supervised by a competent person as defined in 29 CFR 1926.1101(b):    (a) Two-story Multi-unit House at 21 West Areba Avenue, Hershey, Pennsylvania - Employees removed transite roof shingles, which contained 15 percent chrysotile asbestos.  A competent person as defined in 29 CFR 1926.1101(b) did not supervise this Class II work in that even though the foreman and company owner knew the shingles contained asbestos, they did not recognize that the work required controls, including, but not limited to, establishment of a regulated area and use of specific work practices.  Additionally, the on-site foreman had not attended a comprehensive training course for supervisors, certified by the U.S. Environmental Protection Agency (EPA) or another course equivalent in length and content, exposing employees to asbestos hazards, on or about November 7, 2018.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1926.1101(k)(9)(iv): For work with asbestos containing roofing materials, flooring materials, siding materials, ceiling tiles, or transite panels, training shall include at a minimum all the elements included in paragraph (k)(9)(viii) of this section and in addition, the specific work practices and engineering controls set forth in paragraph (g) of this section which specifically relate to that category.
