29 CFR 1910.178(l)(1)(i):   The employer had not ensured that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in paragraph (l) [Reference 29 CFR 1926.602(d) for construction]:   a)  9-19 Greenwood Avenue, Madison, NJ.  The operator of the rough terrain forklift and employees in the area of the fork lift and working on the scaffold where the lift was loading materials, were in danger of injury as the operator of the lift was operating aggressively on the site and he had not completed training and evaluation by his employer on fork lift operations.                              Violation observed on or about 11/08/2018, 11/27/2018, 11/28/2018 and 11/29/2018.

29 CFR 1926.25(a):   During the course of construction, alteration, or repairs,  debris was not kept cleared from work areas, passageways, and stairs, in and around buildings or other structures:   a) 9-19 Greenwood Avenue, Madison, NJ.    Under the scaffolding on the West side of the building under construction, workers were exposed to slip, trip and fall hazards as debris of brick, concrete and lumber was not kept clear from the work area.                                         Violation observed on or about 11/08/2018.

29 CFR 1926.451(e)(1):   When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.  a)  9-19 Greenwood Avenue, Madison, NJ.  Employee was exposed to falls of up to 26 feet to the ground below as worker involved with exterior wall masonry work was using scaffold crossbraces as a means of access from one level to the other.                                   Violation observed on or about 11/08/2018.

29 CFR 1926.451(f)(6):    Scaffolds were erected, used, dismantled, altered, or moved such that they, or any conductive material handled on them, could have come closer than 10 feet for insulated lines between 300 Volts up to 50kv. which is the minimum distance established for specific voltages as set forth in the table in subparagraph (f)(6).  a)  9-19 Greenwood Avenue, Madison, NJ.  Employees working on the fabricated frame scaffold were exposed to electrocution given that the scaffold they erected and were working from was within 5 feet of the overheard primary lines energized at 7,200 Volts Phase to Ground.                                  Violation observed on or about 11/08/2018.

Employees performing masonry activities and located as great as 26 feet above the ground on a fabricated frame scaffold were not trained to recognize and to minimize hazards such as but not limited to fall and electrical hazards when working from the scaffolding. 29 CFR 1926.502(d)(6)(i):   A snaphook of the locking type was not designed for being engaged directly to the webbing of the lanyard:  a)  9-19 Greenwood Avenue, Madison, NJ.  Employee working on the fabricated frame scaffold was exposed to falls of 26 feet to the ground in the event his fall protection failed as he tied the lanyard back on itself by using the snaphook. 29 CFR 1926.502(d)(15):   Anchorage used for attachment for personal fall arrest equipment was not capable of supporting at least 5,000 pounds (22.2 kN) per employee attached nor was it designed, installed and used as follows: As part of a complete personal fall arrest system which maintains a safety factor of at least two; and under the supervision of a qualified person:  a)  9-19 Greenwood Avenue, Madison, NJ.  Employees performing masonry activities and located as great as 26 feet above the ground were using full body harnesses as part of his personal fall arrest system but their lanyards were anchored to cross brace attachment points on the scaffold frames which were not capable of supporting at least 5,000 pounds per employee attached nor were these attachment points designed as fall protection anchors.
