29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified per 29 CFR 1910.178(l): (a) Crown Royal Inc, at 12975 Sheridan Boulevard, Broomfield, CO: On 11/14/18, the employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified per 29 CFR 1910.178(l). An employee operated a Skyjack model SJ1056THS rough terrain powered industrial truck to lower debris from the roof of a three-story structure during roofing work. The employer did not ensure that the operator had successfully completed training and evaluation. This condition exposed employees to struck-by hazards.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or another provision in paragraph (b) of this section which provides for an alternative fall protection measure: (a) Crown Royal Inc, at 12975 Sheridan Boulevard, Broomfield, CO: On 11/14/18, the employer did not ensure that each employee engaged in residential construction activities 6 feet or more above lower levels was protected by guardrail systems, safety net systems, personal fall arrest systems, or another provision in paragraph (b) of this section which provides for an alternative fall protection measure. Employees were re-roofing a three story structure. Employees were tearing off shingles and working on gutters near the exposed roof edge. All employees were not protected by guardrail systems, safety net systems, or personal fall arrest systems. This condition exposed employees to an approximate 29 foot fall hazard.
