29 CFR 1910.212(a)(2): Machine guard(s) on machines were so installed that they offered accident hazards in themselves. On or about November 12, 2018, Bagel Line 2, Bagger Line 7, an employee was pushing accumulated bagels forward on a tabletop conveyor and suffered a partial amputation when the right index finger was caught between the conveyor table and a damaged stainless steel metal guard covering the drive sprocket, a 5/8-inch space.

29 CFR 1910.147(f)(4): During shift or personnel changes, specific procedures were not utilized to ensure the continuity of lockout or tagout protection, including provision for the orderly transfer of lockout or tagout devices between off-going and oncoming shifts. On or about November 15, 2018, in the Production Bagging Area 2, at Bagger Line 7, the employer did not ensure continuous lockout/tagout protection (for the electrical and pneumatic energies) between shift change and employees were exposed to unexpected machine start-up with the guarding removed between the third shift on November 15, 2018 and second shift on November 16, 2018.
