29 CFR 1926.1412(d)(1): Visual inspections were not performed by a competent person prior to each shift for apparent deficiencies of the equipment that was used: a) New residential construction located on Lot #106, Front side: On or about 11/19/2018, and at times prior, the employer exposed employees to struck-by hazards while installing trusses, in that a competent person did not inspect the crane and related equipment for deficiencies prior to the start of operations on site.

29 CFR 1926.1412(d)(1)(x): The employer failed to inspect ground conditions around the equipment for proper support, including ground settling under and around outriggers/stabilizers and supporting foundations, ground water accumulation, or similar conditions. a) New residential construction located on Lot #106, Front side: On or about 11/19/2018, and at times prior, the crane operator exposed employees to struck-by hazards while installing trusses, in that the crane was not resting on a firm foundation (blocking, cribbing and/o mats, and an outrigger pad was missing on the crane's front passenger side. The crane operator failed to inspect prior to setting trusses on the top plate.

The operator-in-training must be monitored by the operator's trainer at all times, except for short breaks where all of the following are met: a) New residential construction located on Lot #106, Front side: On or about 11/19/2018, and at times prior, the crane operator in training for the company was not under continuous monitoring, exposing employees to struck-by hazards, as the trainee was swinging roof truss systems in place on a new residential structure.
