29 CFR 1910.132(d)(1): The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall:    (a)  On or about September 2018 and thereafter, a hazard assessment was not conducted to determine the necessary personal protective equipment required when adding water to the electric forklift batteries.    (b)  On or about November 19, 2018 and thereafter, a hazard assessment was not conducted to determine the necessary personal protective equipment required when cleaning/handling hazardous material.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly.    On or about November 20, 2018 and thereafter, the Daewoo BC20T electric forklift did not have a decal to reflect a 10' carpet pole attachment exposing employees to struck by and tipping hazards.

29 CFR 1910.178(l)(2)(iii): All operator training and evaluation shall be conducted by persons who have the knowledge, training, and experience to train powered industrial truck operators and evaluate their competence.    On or about June 18, 2018 and thereafter, forklift operators were not trained and evaluated by a person who had the knowledge, training, and experience in electric forklifts exposing employees to struck by and tipping hazards.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.  The employer did not train employees who handle hazardous chemicals such as but not limited to:  adhesives which were damaged or opened and forklift battery maintenance.
