29 CFR 1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval.  a) 4th floor:  A forklift stacker was used with a shorty lift boom attached to the fork blades for moving and installing wall panels.  But the capacity, operation, and maintenance instruction plates, tags, or decals were not changed before using the affected forklift.  The addition of using a lift boom affects the lift capacity and safe operation of the forklift stacker, and the lift boom was used without the forklift stacker manufacturer's written approval. On or about 11/21/18.

29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks.   a) 4th floor:   A forklift stacker was used with a shorty lift boom attached to the fork blades for moving and installing wall panels.  Employees operated the forklift in high wind condition to lift a panel that is about 15 feet by 10 feet. The forklift overturned and the wall panel toppled on top of an employee during panel lifting under these conditions. On or about 11/21/18.

29 CFR 1926.602(c)(1)(vii): A safe place to ride forklift trucks was not provided where riding of trucks is authorized.   a) 4th floor:   A forklift stacker was used with a shorty lift boom attached to the fork blades for moving and installing wall panels. An employee was instructed to ride on the forklift stacker to act as additional counterweight for lifting the panel walls. A safe place to ride the forklift stacker was not provided, and the employee was thrown off the forklift when it overturned while lifting a wall panel. On or about 11/21/18.

Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178.  a) 4th floor:  A forklift stacker was used with a shorty lift boom attached to the fork blades for moving and installing wall panels. 29 CFR 1926.760(d)(1): Personal fall arrest systems, positioning device systems and their components were not conform to the criteria in �� 1926.502 (see Appendix G to this subpart).  a) 4th floor:  Employees were installing wall panels at the edge of the building. One employee was tied off to a wall panel lying on the floor as a fall arrest anchor while removing guardrails from the edge of the building. The wall panel on the floor was not structurally secured and was not conform to the criteria of a fall arrest anchor. On or about 11/21/18.

29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who was on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems.  a) 4th floor:  Employee were installing wall panels at the edge of the building without fall protection. Guardrails were removed from the edge of the building and employees were not tied off to fall arrest anchors during the installation process. On or about 11/21/18.  Vescom Systems, LLC was previously cited for a violation of an equivalent Occupational Safety and Health Standard 29 CFR 1926.501(b)(1), which was contained in OSHA inspection number 1200138, citation number 1, item number 2 and was affirmed as a final order on 04/18/17, with respect to a workplace located at Villa BXV Kensington & Sagamore Rd, Bronxville, NY 10708.
