A) MLS Builders LLC on or about November 20, 2018 at the address of 460 Cantbury Boulevard, Perrysburg, Ohio: The employer did not have a plan or program to identify job site hazards which assists employees in maintaining a safe working environment.  Such programs would support the employer and employees in identifying and avoiding potential hazards, such as falls during job site operations, decreasing the probability of employee injury and/or illness.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards.  A) MLS Builders LLC on or about November 20, 2018 at the address of 460 Cantbury Boulevard, Perrysburg, OH: The employer had not trained employees in the appropriate use of fall protection, such as but not limited to, the use of personal fall arrest systems while performing various roofing operations. The employees did not recognize the hazards associated with working from an elevated location (20 feet) without the benefit of fall protection.

29 CFR 1926.451(c)(2)(v): The employer used forklifts  to support scaffold platforms without ensuring that the entire platform was attached to the fork and that the forklift was not moved horizontally while the platform was occupied.  A) MLS Builders LLC on or about November 20, 2018 conducting work at 460 Cantbury boulevard, Perrysburg, OH: The employer did not ensure a platform attachment was securely attached to the forks of the Caterpillar rough terrain forklift. An employee performing wood framing activities from the platform in this condition was exposed to a potential fall of 10 feet.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.  A)  MLS Builders LLC on or about November 20, 2018 at the address of 460 Cantbury Boulevard, Perrysburg, OH: The employer did not ensure employees were protected from falls while installing new roofing materials (OSB) to a new residential type structure.  The employees were exposed to a potential 20 foot fall to the level below.
