29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     (a) J&J Construction at 1815 W. 32nd Ave., Denver, CO: On and before November 28, 2018, the exposing employer did not ensure that employees were protected from injury, in that one employee, conducting framing work on the second floor of a residential home, was not utilizing a fall protection system when working near the edge of the east side of the building. The east side of the building did not have a guardrail system. This condition exposed the employee to a fall hazard of approximately 25 feet from the second floor of the building to the bottom of an adjacent excavation.     (b) J&J Construction at 1815 W. 32nd Ave., Denver, CO: On and before November 28, 2018, the exposing employer did not ensure that employees were protected from injury, in that the two employees, conducting framing work on the second floor of a residential home, were not utilizing a fall protection system when working near north, east, and south interior openings under a 4 foot high Jacuzzi pedestal base. The openings did not have guardrail systems. This condition exposed the employee to a fall hazard of approximately 9 feet 8 inches through the pedestal openings from the second floor to the first floor.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  (a) J&J Construction at 1815 W. 32nd Ave., Denver, CO: On and before November 28, 2018, the exposing employer did not ensure that each employee engaged in framing work on the second floor of a residential construction project were trained to recognize the hazards of falls and the use of fall protection. Two employees were not utilizing a fall protection system when working near openings under a four foot high Jacuzzi pedestal on the second floor and were exposed to a fall hazard of 9 feet 8 inches from an interior fall to the first floor. One employee was not utilizing a fall protection system when working near the edge of the east side of the building and was exposed to a fall hazard of approximately 25 feet from an exterior fall to the bottom of an adjacent excavation.   Abatement Note: The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas: 1) The nature of fall hazards in the work area; 2) The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; 3) The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used;   4) The role of each employee in the safety monitoring system when this system is used;  5) The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs;  6) The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and  7) The role of employees in fall protection plans; 8) The standards contained in this subpart.
