29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: (a) Mendoza Demolition Services, Inc. at 3205 Quivas St., Denver, CO 80211: On or before October 28, 2018 the exposing employer did not ensure that daily inspection of an excavation, which was approximately 30 feet in width, 30 feet in length and 13 feet in depth were made by a competent person for evidence of a situation that could have resulted in a hazardous condition, in that the person conducting the inspections was not capable of identifying existing and predicable hazards with the excavation. This condition potentially exposed employees to a crushing hazards by excavation wall cave-in. Abatement Note: "Competent person" means one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.
