29 CFR 1910.95(d)(1)(i): The sampling strategy was not designed to identify employees for inclusion in the hearing conservation program and to enable the proper selection of hearing protectors: (a) On or about December 4, 2018, and at times prior, the employer did not ensure that employees were included in the sampling strategy for inclusion in the hearing conservation program exposed to noise above the action level of 85.0 dB(A). An employee was exposed to a noise level of approximately 88.2 dB(A), which was measured over an 8-hour TWA while engaged in glass fabrication operations. (b) On or about December 4, 2018, and at times prior, the employer did not ensure that employees were included in the sampling strategy for inclusion in the hearing conservation program exposed to noise above the action level of 85.0 dB(A). An employee was exposed to a noise level of approximately 88.8 dB(A), which was measured over an 8-hour TWA while engaged in glass fabrication operations.
